Filing a False Police Report – MCL 750.411a – Dismissed

Attorney Jordan’s client, Darryl McMillion, reported a carjacking to the Livonia Police Department. Instead of investigating the crime, a police officer became suspicious of him, obtained a warrant, and had him arrested for filing a false police report. Because the original reported offense was a felony, the false-report charge was also treated as a felony.

At the district court hearing, the police officer testified about why he sought the warrant, and the case was bound over to circuit court. The matter was assigned to Judge Linda Parker (now a federal judge). Attorney Jordan filed a motion to quash the information, arguing that there was insufficient evidence to support the charge.

Judge Parker agreed. The case was dismissed.
