Felonious Assault (2 Counts) – MCL 750.82 – Not Guilty (Jury)
Felony Firearm – MCL 750.227b – Not Guilty (Jury)
A young man sent his girlfriend and her friend to retrieve his belongings from his parents’ home. An argument occurred, and afterward the girlfriend went to the police and accused the parents of assault. The father was charged with two counts of felonious assault for allegedly pointing a gun at the girlfriend and her friend, along with a felony firearm charge. The mother was charged separately with misdemeanor assault and battery.
The mother refused a plea deal and proceeded to trial, where she was convicted based on the testimony of the alleged victims. Shocked by the outcome and facing the possibility of prison himself, the father realized he needed an experienced trial attorney and retained Carl Jordan.
Attorney Jordan thoroughly reviewed the evidence, including transcripts from the wife’s trial. The prosecution refused to dismiss the charges, so the case proceeded to jury trial.
During the trial, the prosecutor called the alleged victims to testify. Through cross-examination, Attorney Jordan exposed inconsistencies in their accounts. In closing arguments, he emphasized these contradictions and argued that the jury could only return a verdict of Not Guilty given the reasonable doubt surrounding the accusations.
After one hour of deliberation, the jury returned Not Guilty verdicts on all charges.
