Assault and Battery – MCL 750.81 – Not Guilty (Jury)
Attorney Jordan’s client was charged with simple assault and battery after the mother of her husband’s son accused her of attacking her during a custody exchange. The client faced up to 93 days in jail, a $500 fine, and the possibility of up to a year of probation.
According to the complainant, the client threw snowballs and tried to assault her. A neighbor also came forward as a witness to corroborate the accusation.
At trial, Attorney Jordan’s cross-examination revealed that the allegations were false and motivated by personal animosity. The neighbor was shown to be a friend of the complainant who came to court to support a false claim.
After discrediting both the complainant and the witness, the jury returned a Not Guilty verdict. The client left the courtroom with her record completely intact.
